NEWSLETTER TERMS AND CONDITIONS

§1 Key Information about the Service Provider

The digital services and content provided within the scope of the Newsletter are delivered by Natalia Łowicka, who conducts business operations under the name Atelier Natalia Łowicka, headquartered in Białystok, Sienkiewicza 49/107, 15-092 Białystok, NIP 5423306789, REGON 369882600 (referred to as the Service Provider). For all matters, you can contact me at the following e-mail address: info@natalialowicka.pl.

A glossary of terms is available in §10 of these Terms and Conditions.

§2 Key Information about the Newsletter

1. The Newsletter, including services and digital content, is sent to the e-mail address you provided.
2. The Newsletter contains educational content, as well as information about new posts, materials shared on social media, discounts, current promotions, bonuses, free and paid events, challenges, training, and other marketing and commercial information about products and services offered or recommended by the Service Provider.
3. If digital content (e.g., e-book, audio/video recording) is made available as part of the Newsletter, you can access it as indicated in the e-mail (e.g., by clicking an active link provided in the e-mail).
4. Since email programs often mark messages sent from mailing programs as SPAM, it is recommended to add the Service Provider to your trusted recipients list.

§3 Subscription Terms and Access to the Newsletter

1. You can access the Newsletter:

1. Free of charge – by subscribing to the Newsletter and providing your e-mail address, name, or other personal data required in the subscription form for marketing/commercial purposes, or
2. For a fee – without the need to subscribe to the Newsletter, i.e., by paying a gross amount of 99 PLN for access to the digital content provided free of charge within the Newsletter. To make a purchase, please contact the Service Provider at the e-mail address indicated in §1 or by another specified means.

2. To subscribe to the Newsletter and access the service/digital content:

1. Provide your personal data in the available subscription form,
2. Accept the newsletter’s terms and conditions,
3. Confirm your e-mail address – if it is indicated during the subscription that you need to confirm your e-mail address (double opt-in mechanism).

3. The agreement for the provision of access to digital content is concluded for an indefinite period:

1. Once the Client is shown a confirmation of the Newsletter subscription (for free access),
2. Upon acceptance of the store’s terms and conditions and payment for access to digital content (for paid access).

4. Access to the Newsletter, including provided services and digital content, is granted immediately after the agreement is concluded unless otherwise stated in the Service Description. If access is not obtained, the Service Provider should be notified.
5. The contract for the provision of access to the Newsletter, including the delivery of services and digital content, can be terminated immediately by you. To terminate the contract:

1. Click the „Unsubscribe” / „Cancel Subscription” button or a similar button, or
2. Contact the Service Provider.

§4 Technical Conditions

1. The Service Provider declares that due to the public nature of the Internet and the use of services provided electronically, there may be a risk of unauthorized persons obtaining and modifying customer data. Therefore, the use of appropriate technical measures that minimize the above risks is recommended. The Service Provider never asks the Client to provide the password in any form.
2. To subscribe to the Newsletter or place an order for paid access to the Newsletter, you must have the latest version of a web browser supported by the manufacturer with internet access (e.g., Opera, Mozilla Firefox, Google Chrome, Safari), and an active e-mail account.
3. To use the Newsletter, including the services and digital content provided, you must have:

1. The latest version of a web browser supported by the manufacturer with internet access (e.g., Opera, Mozilla Firefox, Google Chrome, Safari),
2. An active e-mail account,
3. The current tool/software that supports electronic files in the format in which digital content is delivered (e.g., *.zip, *.pdf, *.mobi, *.pub, *.doc, *.docx, *.xsl),
4. An account on a social media platform, e.g., Meta (Facebook), if the description of the digital content indicates that it will be made available, among others, to a dedicated group.

4. If additional technical requirements are necessary to use the Newsletter, including the provided services and digital content, you will be informed about it. You will also be informed if updates are required to maintain the compatibility of services and digital content with the Agreement.

§5 Complaints

1. If the provided services/digital content are not in accordance with the agreement, you may request compliance with the agreement or make a statement about reducing the price (in the case of a paid service) or withdraw from the contract.
2. The Service Provider shall consider complaints within 14 days from the day of receiving the complaint.
3. Complaints can be made by email, in writing, or in any other way indicated for communication.
4. The Service Provider may refuse to bring the service/digital content into compliance with the contract if it is impossible to bring the service/digital content into compliance in the manner chosen by the Customer or would require excessive costs on the part of the Service Provider. When assessing the excessiveness of costs, all circumstances of the case shall be taken into account, in particular, the significance of the lack of compliance of digital content or digital service with the contract and the value of the digital content or digital service in accordance with the contract.
5. The obligations and rights of the Parties, including the detailed rules for the complaint of digital service/content, are specified in the Consumer Rights Act (e.g., in chapter 5b of the Act).

§6 Withdrawal from the Agreement

1. You may withdraw from the Agreement within 14 days from the date of concluding the contract. To exercise the right to withdraw from the contract, the Customer should inform the Service Provider in a clear statement, for example, by email or letter to the address indicated in the Regulations.
2. You may withdraw from the Agreement in the event of non-delivery of content or digital service.
3. In case of withdrawal from the contract, you should refrain from using the digital content or digital service and making them available to third parties.

§7 Copyright and Licenses

1. Texts, photos, graphics, multimedia, and trademarks provided within the Newsletter are copyrighted under the Act of February 4, 1994, on copyright and related rights, protected by law.
2. Copyright to the aforementioned materials is held by the Service Provider or another entity from whom the Service Provider obtained the appropriate license. Materials can also be used by the Service Provider based on another legal basis.
3. All materials provided by the Service Provider may be used exclusively for personal use unless otherwise agreed by the Parties. Unauthorized further distribution, sharing, recording, and downloading of materials beyond the scope of permitted use are prohibited.
4. In the event of a breach of the prohibition referred to in this paragraph, including a breach of copyright, the Service Provider has the right to claim compensation and redress from the Customer. The Customer may be liable for civil or criminal liability in this respect.

§8 Personal Data

1. The Service Provider is the administrator of your personal data. Your data is processed for the following purposes:

1. Data necessary for the conclusion and implementation of the contract will be processed for the duration of the contract, including for the duration of the rights arising from the contract (Article 6(1)(b) and (f) GDPR). Providing this data is voluntary but necessary for the conclusion and implementation of the contract;
2. Additional data provided to facilitate the implementation of the contract will be processed no longer than until you object or the business purpose based on a legitimate interest in customer service (Article 6(1)(f) GDPR) ceases.
3. Data will also be processed for the period of limitation of claims based on the legitimate interest of the Service Provider in defending against claims and for the purpose of establishing and pursuing claims (Article 6(1)(f) GDPR).
4. Data may also be archived for internal and statistical purposes until you object or the business purpose based on a legitimate interest of the Service Provider (Article 6(1)(f) GDPR) ceases.
5. In the case of data collected for marketing and commercial purposes, including for sending marketing information as part of the Newsletter service, the data will be processed based on the legitimate interest of the Service Provider in marketing the products and services of the Service Provider (Article 6(1)(f) GDPR) and based on your consent. Your data will be processed no longer than until you object/withdraw consent or the business purpose ceases – whichever occurs first. Providing data is voluntary, but necessary to receive marketing/commercial information. You can withdraw your consent at any time by clicking the link in the email footer or by writing to the Service Provider at the address provided above.

2. Your data may be entrusted to other entities only when it is necessary to achieve the processing purposes mentioned above and only to the extent necessary to achieve this purpose. If necessary, your data may be transferred to a hosting company, entities supporting the service and sending of the Newsletter, the Meta social platform, a cloud service company, entities providing marketing services, and other entities that support the Administrator in achieving the processing objectives.
3. The Service Provider uses the Mailerlite program to send the Newsletter provided by MailerLite Limited, an Irish registered company at Ground Floor, 71 Lower Baggot Street, Dublin 2, D02 P593, Ireland.
4. Detailed information on the Privacy Policy of the entity providing the Newsletter sending service can be found at: https://www.mailerlite.com/legal/cookie-policy.
5. Under GDPR, you have the right to access your personal data, rectify personal data, delete personal data, restrict the processing of personal data, object to the processing of personal data, transfer personal data, withdraw consent, with the proviso that withdrawing consent does not affect the legality of processing carried out before its withdrawal.
6. If you believe that your personal data is processed in violation of applicable law, you have the right to lodge a complaint with the President of the Office for Personal Data Protection. In such a case, however, I encourage you to contact me first to clarify your concerns.

§9 Final Provisions

1. When using the Newsletter, including the service or digital content, it is prohibited to provide information of an unlawful nature and to act in a manner contrary to the law, good manners or infringing the personal rights of third parties.
2. Amicable dispute resolution and handling complaints for consumers is possible by referring to:

1. the permanent amicable consumer court with a request to resolve a dispute arising from the concluded contract;
2. the provincial inspector of the Trade Inspection with a request to initiate mediation proceedings to amicably end a dispute between the Client and the Seller;
3. district (city) consumer rights spokesperson or a social organization whose statutory tasks include consumer protection, to seek assistance in contract matters;
4. or has the right to use the ODR platform. The platform is used to resolve disputes between consumers and entrepreneurs http://ec.europa.eu/consumers/odr.

3. The Service Provider reserves the right to make changes to the Regulations for valid reasons, in particular due to changes in legal regulations that require the Service Provider to also change the content of these Regulations, in particular changes to the Civil Code, the Consumer Rights Act, the Act on the provision of services by electronic means, and also due to the valid decisions of UOKIK, PUODO or court judgments in the scope corresponding to the issued decisions/judgments, and in the event of a significant change in business factors, provided there is a cause-and-effect relationship between the aforementioned change and the change in the cost of providing services by the Service Provider. Detailed information about the changes is indicated by the Consumer Rights Act.

§10 Glossary of terms

1. Price – money or a digital representation of value;
2. Client – an entity that has entered into a contract with the Service Provider for access to the Newsletter, including the provision of services and/or digital content;
3. Consumer – a natural person who has entered into a contract with the Service Provider for purposes not directly related to their business/professional activity;
4. Digital content – data created and provided in digital form (e.g. e-book, other materials in pdf form, audio/video);
5. Service – service or digital content or a good with digital elements;
6. Digital service – a service allowing the Client to produce, process, store, or access data in digital form or a service allowing shared use of data in digital form, which was transmitted or produced by the Client or other users of this service or other forms of interaction using such data;
